Motorcycle Rollover Accidents

Motorcycle Crashes

For most people who ride motorcycles, it goes much deeper than just a mode of transportation. There is a real joy they feel when they are driving on the open road. Unfortunately, it is that same openness that leaves the rider totally vulnerable to catastrophic injuries when there is a motorcycle accident.

One of the most dangerous types of motorcycle accidents is a rollover crash. This happens when the motorcycle overturns or flips over. A motorcycle rollover accident can happen if the bike is “tripped” by another object that causes it to turn over – such as a car, truck, or other vehicle. In rollover accidents, it isn’t that any of these other vehicles hit the motorcycle, rather, it is the actions of the driver of that vehicle that causes the rollover. For example, if an aggressive driver in a car jumps from lane to lane sporadically, they can cause a motorcyclist to have a rollover accident. A motorcycle rollover accident can also happen because of a pothole or other issue in the road, or from a defective part in the bike.

Negligence
If the rollover accident was caused by another party’s negligence, then the victim can file a lawsuit against that party. Most states follow the “comparative negligence doctrine,” which means that if the victim is deemed to be less than 50 percent at fault, they could still be entitled to financial compensation for their losses. For example, if it is determined that the victim did something that partially caused the crash and that behavior was 25 percent responsible for the crash, then the victim would receive the total amount of damages minus 25 percent.

A motorcycle victim can pursue damages for medical expenses, loss of income, pain and suffering, emotional anguish, permanent disability, scarring, disfigurement, loss of life enjoyment, and more. If the accident is a fatal one, then the victim’s family can pursue a wrongful death lawsuit against the at-fault party. The victim’s estate may also be able to file a survival action, with any damages awarded given to the victim’s heirs.
